The game of rugby union has for too long been perceived as a game associated with drunken boorish behavior. In the last few years great care has been taken to, and great strides have been made, in changing those perceptions. The manner in which Mr. Donovan comported himself on the night of 8 April has done a great deal to negate the progress toward improving the image of rugby as a serious competitive sport and not an excuse for drunken debauchery. Each of the people who called 911 on the night of 8 April 2006 and all of the people who heard Mr. Donovan’s drunken profane tirade will not go and tell their friends, acquaintances, and co-workers about their weekend get-away that was spoiled by a drunken lout. Those friends, acquaintances and co-workers will tell others, the end result being another public relations debacle for the game of rugby. Andy McDonnell Chairman Northeast RFU Ad-Hoc Disciplinary Committee ________________________________________________________________________ Date: Wed, 19 Apr 2006 All, The Northeast RFU Ad-Hoc Disciplinary Committee has reviewed all of the information gathered in regard to the incident of 8 April at the East Hampton Resort and has determined that no sanctions are to be brought against the Charles River RFC. In the face of grossly inappropriate behavior by one of its members, Charles River RFC’s leadership showed remarkable tact and diplomatic skill in it's handling of the situation. To its credit Charles River RFC rapidly removed the miscreant member from the area, made full financial restitution to the establishment, and did a commendable job in public relations repair. Although official sanctions are not being issued against Charles River RFC the Disciplinary Committee is issuing a formal admonishment to the club for its lack of oversight of one of its members. Additionally the Disciplinary Committee would like the club to be aware that if another similar incident were to occur, significant punitive measures will be taken against Charles River RFC. Andy McDonnell Chairman Northeast RFU Ad-Hoc Disciplinary Committee ________________________________________________________________________ Date: Fri, 7 Apr 2006 All, After due and careful deliberation the Met-NY RFU Disciplinary Chairman has determined that Mr. Dan Holzhauer has been suspended from play for a period of 2 Weeks for the infraction during play on 4/2/06 for a Major Physical Offense as per the USA Rugby Regulations and Procedures for Discipline Actions. Mr. Holzhauer is eligible to resume play on 23 April 2006. In addition, it has been determined that Mr. Tom Gordon is effective immediately on probation until 23 April 2006 based on his actions as a "third man" related to this incident. In retrospect from the referee, this incident merited a red card, however, since this card was not issued a probation period will be levied as outlined above. The earliest date on which you are next eligible to resume participation is 23 April 2006. Andy McDonnell Chairman Northeast RFU Ad-Hoc Disciplinary Committee ________________________________________________________________________ Date: Sat, 08 Apr 2006 All, After due and careful consideration, the Northeast RFU Ad-Hoc Disciplinary Committee has unanimously determined that you be suspended from play for a period of three weeks or three matches, whichever is longer, for the offence of "physical or attempted physical assault on a referee". The earliest date on which you are next eligible to resume play is 23 April 2006. The safety of the referee in Rugby since the inception of the game has been, and continues to be sacrosanct. If you were to view the disciplinary guidelines as posted on the USARFU web site (http://www.usarra.org/DisciplinaryRules.pdf ) you would note that the minimum recommended sanction for physical or attempted physical assault on a referee is a five year suspension. Your suspension is as stated above, considerably shorter than the recommendation. The reasons for this are fourfold: • Mr. Davis' (the referee) statement that he felt not at all threatened just surprised, at your actions • Your immediate departure from the playing enclosure after the incident • Your coming forward with an admission of your actions after another player had been incorrectly named in your stead • And lastly, your statement to the Disciplinary Committee which conveyed your sincere contrition Be forewarned Mr. Welch that if an incident of a similar nature were ever occurs again the suspension you will face will be at least the minimum recommendation of five years.
